Recent Ordinance Changes Approved by Atwood Village Board

The Atwood Village Board voted on certain ordinance changes at their meeting on August 8. Listed below are the ordinances and the changes made:

ORDINANCE 2022-O-11 to adopt specifications on fences within the Village of Atwood. This simply means before you can erect a fence on your property, you MUST obtain a permit.
30.20 ELECTIONS: FUNCTIONS. The Board of Trustees shall be paid $50 per month (formerly $25) for attending one board meeting per month and $50 per month (formerly $25) for attending one committee meeting per month.
30.21 MEETINGS (A) The regular meeting of the board shall be held on the second (not third) Monday of each month at the hour of 6 p.m. (not 7 p.m.), provided that, if the regular meeting is on a legal holiday, the meeting shall take place on the next day at the same hour.

30.27 STANDING COMMITTEES: The following shall be the standing committees of the Village Board of Trustees:
A. Police B. Water & Sewer C. Streets & Alleys D. Finance and Special Projects (formerly Finance) E. Park (formerly Health) F. TIF and Zoning (formerly mosquito spraying) G. Civic Improvement (formerly and Public Relations Zoning).

30.29 MEMBERSHIP IN COMMITTEES: The President/Mayor shall appoint the members of all standing and special committees, in the absence of specific direction by the board, and shall designate the chairperson thereof. Every committee of the board shall consist of a minimum of two (formerly three) members including the chairperson unless the Board of Trustees shall provide otherwise.

50.02 RECEPTACLES: (B) Such containers shall be of metal (NEW-or heavy plastic on wheels), or suitable water-tight, with a tight-fitting cover, equipped with suitable metal handles, and of a size as to be easily handled by one person.

50.03 REMOVAL OF GARBAGE: All garbage shall be removed at least one each week. (Section removed: except during the months of December, January, February and March, during which four months all such garbage shall be removed at least once each week).

50.05 BURNING OR THROWING GARBAGE ON THE GROUND: It shall be unlawful for any tenant, lessee, or occupant of a dwelling to throw garbage on the ground or upon any public street or alley of the village, or to burn garbage or attempt to burn garbage within the village limits (Section Removed: without the use of a metal incinerator designed for and capable of burning wet garbage).

51:03 SERVICE CONNECTION PERMITS AND FEES: C. The service connection fee for obtaining a permit to connect to the water main is $100 (formerly $400). Each water meter is deemed to be a separate connection. The customer is responsible for the costs of material and labor for the water connection. (New wording: The service connection fee for obtaining a permit to connect to the sewer main is $100 per connection. The customer is responsible for the costs of material and labor for the sewer connection).

51.35 RATES: A. There shall be and there are hereby established rates or charges for the use of and for the service supplied by the combined waterworks and sewerage system of the village based upon the amount of water consumed as shown by the water meters. (New wording: Current rates are on file in the Village Clerk’s office and are available for review by anyone upon request). (1 & 2 Deleted) B. through J remain as is).

52.36 RATES: A. The established rates or charges for the use of the service provided by the sewerage system of the village are based upon the amount of water consumed as shown by the water meters. (New wording: Current rates are on file in the Village Clerk’s office and are available for review by anyone upon request). (1) Delete (2) Delete.

73.51 GOLF CARTS: B. Item (2) Any person who operates a golf cart or UTV must be at least 16 (formerly 21) years of age and possess a valid driver’s license to operate a motor vehicle issued by the state or any other state.

ZONING 155.057-MEMBERSHIP AND TERMS OF OFFICE: A. Board of Zoning Board of Appeals shall consist of five members. Each successor shall be appointed by the Village Board of Trustees for a period of five years. (NEW WORDING: One Zoning Board of Appeals member shall be the Village Board Trustee serving as Chairman of the Zoning Committee. A second Zoning Board of Appeals member shall be the Village’s Building Inspector/Commissioner. The remaining three Zoning Board of Appeal members shall be appointed by the Village Board of Trustees).

ZONING 155.059 – JURISDICTION OF THE BOARD OF ZONING APPEALS: B. The concurring vote of three (NOT FOUR) members of the Board of Zoning Appeals is required to reverse any order, requirement, decision, or determination made by the administrative official charged with the enforcement of this chapter.
